The following terms and conditions apply to promotions offered by Lotto.com including Mystery Scratch. For the purposes of this document, the term “promotion” means an invitation to obtain official state lottery tickets through Lotto.com where the cost of specified ticket(s) and/or the convenience fee have been reduced or waived, including, but not limited to, through credits, discounts, or promotional codes. Unless explicitly specified otherwise, promotions are offered by Lotto.com and are not sponsored, endorsed, administered by or associated with any other person or entity.
All promotions are subject to these Promotional Terms which supplement Lotto.com’s general Terms and Conditions (collectively, the “Terms”). It is your responsibility to ensure that you have read and understand the Terms before taking part in any promotion. We reserve the right to change these Terms at any time and for any reason. By using any promotion, you are agreeing to these Terms as modified and in effect at the time of use.
General Promotional Terms
Only one (1) promotion can be used per order. A promotion may not be used in combination with other promotions or discounts.
Promotions are non-transferable and not redeemable for cash or credit.
Promotions are only valid for the specified product, if any.
Promotions are limited to one (1) use per customer.
All promotions are subject to availability and any applicable limits or caps which may be established by Lotto.com.
We reserve the right to modify or cancel any promotion at any time and without notice.
Unless otherwise stated at the time given, promotional credits may be withdrawn or canceled by Lotto.com if not used within 30 days.
Void if prohibited by law or rule in a specific jurisdiction.
We are not liable for any loss arising out of the refusal, cancellation or modification of any promotion or any failure or inability of a customer to take advantage of a promotion for any reason.
Customers must be physically present in a state in which Lotto.com operates to redeem a promotion. Lotto.com reserves the right to limit promotions to specific locations, states, and timeframes.
Promotion-Specific Terms
Discount and Free Ticket Promotions: Discount and free ticket promotions, which reduce the cost of an order by a fixed dollar value (i.e. $2 off) or a percentage value (i.e. 25% off), or gives the customer an opportunity for a free ticket (whether via an account credit, a credit at check-out, a Buy One, Get One offer, or any other method), are all subject to the following additional terms:
The discount code must be entered prior to completing the order.
Service fee still applies.
If the promotion has a minimum purchase requirement (i.e Place an order for $5), the service fees do not apply towards or otherwise reduce the minimum purchase amount.
The free ticket for a Buy One, Get One offer must be of equal or lesser value than the ticket ordered to qualify for the offer. Lotto.com reserves the right to designate the specific ticket type that can be received pursuant to this type of promotion.
The value of any Free Ticket promotion is equal to the value of one line of the designated game excluding any add-ons, multipliers, or other game promotions or purchases.
Second Chance Promotions: Second Chance Promotions, which gives a customer a non-payable account credit to order tickets if the first order does not win, are subject to the following additional terms:
New customers only.
Only eligible on a customer's first order (regardless of product ordered).
Maximum value of $10. A non-payable account credit equal to the lesser of (i) the order price (excluding service fees) of the non-winning order or (ii) $10, will be given.
If multiple lines, draws, or tickets are ordered, all such lines, draws, and tickets must be non-winners to be eligible.
Customers with a non-winning order will automatically receive an email to activate the offer.
To claim the offer, you must click the “Take your Second Chance” button in the email.
Offer must be activated within 90 days of receipt.
The credit granted may only be used for Lotto.com orders.
If the first ticket is part of a subscription, the offer is valid on the first ticket only.

THE GAME AND YOUR PARTICIPATION THEREOF IS SUBJECT TO THE LOTTO.COM TERMS AND CONDITIONS AND PRIVACY POLICY INCLUDING THE PROVISIONS IN SECTION 12 REGARDING BINDING ARBITRATION AND WAIVER OF CLASS ACTION AND SECTION 14 ON LIMITATIONS OF REMEDIES.
Description of Promotion
Eligible Lotto.com account holders (“participants”) must login to their Lotto.com account to access the Mystery Scratch Game (the “Game”). When the Game is available, participants will be given up to three (3) chances per day to reveal tiles on the Game for a maximum of twenty-one (21) weekly chances. The tiles must be revealed by 11:59:59 PM EST each day the Game is available. If the tiles are not revealed on any particular day, your opportunity to reveal tiles for that day are forfeited. Revealed tiles will remain revealed until the weekly reset of the Game each Monday at 12:00:00 AM EST.
To win a prize, participants must match three (3) identical symbols prior to the weekly reset, subject to the limitations set below.
Eligibility; Limitations
The Game is open to participants with a valid Lotto.com account in accordance with Lotto.com’s Terms and Conditions. If you do not have a Lotto.com account, you can create one for free at Lotto.com. By creating and maintaining a Lotto.com account, you agree to Lotto.com’s Terms and Conditions and Privacy Policy (collectively, the “Terms”). If you do not agree to the Lotto.com Terms, you cannot create a Lotto.com account or participate in the Game. You must meet all eligibility requirements set forth in the Terms in order to participate in the Game.
Participants in the Game must be at least the minimum age required to request or purchase lottery tickets in their jurisdiction (e.g. at least eighteen (18) years of age in New York). Employees, directors, officers and those otherwise associated with Lotto.com, its affiliates or related companies, or affiliate employees, or with the Game as a third-party vendor of Lotto.com are ineligible to participate in the Game or receive a prize.
In addition to the other requirements within these Rules, Lotto.com reserves the right to refuse or otherwise restrict an individual’s participation in the Game or any other Lotto.com promotions for any reason, in our sole discretion.
Individuals who are entered into Lotto.com’s self-exclusion program or have otherwise excluded themselves from participating in the Lotto.com services will not be able to participate in the Game or win prizes.
Only one prize can be won in a day. Once three (3) winning tiles have been revealed, those tiles may not be used for additional prizes. You cannot win the same prize twice in one week. Limit of two (2) prizes per participant per week.
Acceptance of Rules and Terms
By participating in the Game, you acknowledge and agree that you have reviewed and accepted these Rules and Lotto.com’s Terms. You further agree to abide by these Rules and the decisions of Lotto.com, which are final and binding in all respects. In the event of a change in, modification to, or amendment of the Game or these Rules, your continued participation in the Game constitutes acceptance of the modified or amended Rules or Game.
Words, terms or phrases not defined herein shall have the meanings ascribed to them in the Terms.
Prizes
Prizes may include non-payable site credits, discounts, or cash prizes. The available prizes during any week in which the Game is available are subject to change at the sole discretion of Lotto.com. Prizes are only available in jurisdictions where the Game is offered.
Cash Prize winners will be contacted by a Lotto.com representative to confirm identity and eligibility within seventy-two (72) hours. Verification may include submission of government-issued ID, proof of residence, and tax documentation. Prize winners must complete and submit all required and necessary tax forms, as determined by Lotto.com, prior to a prize deposit. Cash prizes will be deposited into your Lotto.com account as payable credits after verification and submission of tax forms. If Lotto.com does not receive a response from you or cannot confirm your eligibility or identity within thirty (30) days of being contacted, you forfeit the prize.
Site Credit will be automatically applied to the participant’s Lotto.com account as non-payable credits. All site credit prizes have no cash value, are non-withdrawable and may only be used for Lotto.com services. Service fees apply when used. Site credit must be used within six (6) months of being credited to your account. Lotto.com may withdraw, remove, or cancel any unused credits at any point thereafter, without notice.
Discount Prizes will be provided via email to the email address associated with the participant’s Lotto.com account. Unless otherwise stated, discount prizes are valid for forty-eight (48) hours after the third symbol for a particular discount prize is revealed. Service fees apply when used.
All prizes are non-transferable and cannot be exchanged or substituted. The outcomes of each weekly cycle of the Game are determined by a random number generator, which produces a random sequence of the symbols. The odds of a participant receiving any given symbol is based on a pre-programmed hit probability that is assigned to such symbol, which may change from time to time in Lotto.com’s sole discretion. Lotto.com reserves the right to change the prizes at any time. Any changes to the prizes will be reflected in these Rules.

Site Credits and Discount prizes must be redeemed and used in states and jurisdictions where Lotto.com operates. If Lotto.com is unable to award a prize for whatever reason, it may substitute or change such prize in its sole discretion. Lotto.com reserves the right to withhold, deny, withdraw from an account or void any prize if we are unable to verify a participant’s eligibility or if we suspect fraud.
Administration of the Game; Suspension, Amendment, Modification to the Game
The Game is provided and powered by a third-party vendor and made available to you by Lotto.com. Lotto.com shall have the right, in its sole discretion and for any reason, to offer, modify, suspend, change, or terminate the Game at any time and in any jurisdiction.
In the event of an error or malfunction in the Game, all Game play (including prizes) resulting from the error or malfunction will be voided. Lotto.com reserves the right to remove any part of the Game from the site at any time. Any part of the Game that indicates incorrect behavior affecting Game data or prizes, that may be due to error, misconfiguration or a bug, will be cancelled and any play or winnings will be voided. Under such circumstances Lotto.com reserves the right to alter game results, at our sole discretion, in order to correct any mistake.
We reserve the right to declare participation in the Game void, partially or in full, if, in our sole discretion, we deem there was an error, mistake, misprint or technical error. If you are incorrectly awarded a prize for any reason, you agree that Lotto.com will not be liable to award you any such prizes, and you agree that any such prizes awarded in error will be voided. If there is a discrepancy between the result showing on a participant's device and the server software administering the Game, the result showing on the server will be the official and governing result.
Any attempt to circumvent the mechanics of the Game, misuse promo codes, or exploit system vulnerabilities will result in disqualification and possible account suspension. The Game is powered by a third-party system. Lotto.com is not responsible for any technical errors, delays, or outages caused by the third-party provider.
Taxes
Prizes may be subject to tax withholding and reporting. Winners are solely responsible for all applicable federal, state, and local taxes. We will report your winnings to the appropriate state or federal authorities if required by law.
Publicity
Where permitted by law Lotto.com may request that you participate in a prize-winning ceremony which may include photography and media interviews.
LIMITATION OF LIABILITY
IN ADDITION TO THE LIMITATION OF LIABILITY SET FORTH IN THE TERMS, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL LOTTO.COM AND ITS PARENTS, SUBSIDIARIES AND OTHER AFFILIATED ENTITIES AND THEIR RESPECTIVE OWNERS, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS, AND THIRD PARTY VENDORS PROVIDING OR SUPPORTING THE GAME BE RESPONSIBLE OR LIABLE, EVEN IF FORESEEABLE OR EVEN IF THE ABOVE ENTITIES AND INDIVIDUALS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR OTHER DAMAGES WHETHER IN AN ACTION OF CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO YOUR PARTICIPATION IN THE GAME, THESE RULES, THE TERMS, OR REDEMPTION OF A RELATED PRIZE.
Governing Law
The Game, and your participation thereof, and these Rules are governed by the laws of the State of New Jersey. Any disputes arising out of or relating to this Game or these Rules shall be resolved exclusively in the state or federal courts located in New Jersey.
Miscellaneous
No waiver of any of the provisions of any term or condition of these Rules or the Terms by Lotto.com shall be deemed or shall constitute a further or continuing waiver of such term or condition or a waiver of any other term or condition hereof, and any failure of Lotto.com to assert a right or provision under these Rules shall not constitute a waiver of such right or provision. If any provision of these Rules, or the Lotto.com Terms, is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Rules or the Lotto.com Terms or limited to the minimum extent such that the remaining provisions will continue in full force and effect.
